McVay Appeal Dismissed and Murder Conviction to Remain of Record

Attorney General Marty Jackley announced today that the South Dakota Supreme Court has dismissed the appeal of James V. McVay. McVay, an inmate at the South Dakota State Penitentiary, committed suicide on September 2, 2014 while serving a capital sentence for the stabbing death of Maybelle Schein.

Attorney General Marty Jackley announced today that his office will seek a new execution date for Rodney Scott Berget after the South Dakota Supreme Court denied Berget’s petition for rehearing.
